NEWARK, N.J. (AP) — Elder Help Network is calling on a New Jersey superior court judge to take stronger measures to protect a 90-year-old stroke survivor from alleged financial exploitation involving his classic Acura NSX.

In an amicus curiae filing in Morris County Superior Court, the organization supports plaintiff Robert Kerekes in his lawsuit against Samuel Polyak of Polykup. David Gutwill of Ultimate Car Care is also named in connection with the custody of the vehicle.

The dispute stems from a contract for a premium electric vehicle conversion. The brief alleges that Polyak substituted Tesla batteries with recalled Chevrolet Bolt batteries and that the car was not fully returned after a court-ordered replevin.

An eyewitness from Vintage Motor Management is prepared to testify that an associate of the defendants had confirmed possession of all parts before the vehicle’s incomplete return, according to the filing. Explanations from the defendants later changed, the group said.

The amicus brief, submitted to Civil Presiding Judge Frank DeAngelis, requests enforcement of the April 14, 2026 Writ of Replevin, issuance of subpoenas and a criminal referral under New Jersey’s elder protection statutes.

Elder financial exploitation remains one of the most common yet underreported forms of abuse against seniors, according to advocacy groups. The court has not commented on the pending motion.
