Extended Producer Responsibility (EPR) & Battery Waste Authorization in India

Date:

Extended Producer Responsibility (EPR)

Plastic has a wide variety of applications, and its physical and chemical properties have contributed to its widespread commercial use and performance. However, the indiscriminate dumping of plastic has become a significant threat to the environment. In particular, the biggest contributors of littered waste are plastic carrying bags and, every year, millions of plastic bags end up in the atmosphere vis-à-vis the soil, water sources, rivers, etc. It takes an average of 1,000 years to fully decompose. In order to resolve the issue of scientific plastic waste management, the Plastic Waste (Management and Handling) Regulations 2011 were also notified in 2011, which included the management of plastic waste.

The Extended Producer’s Responsibility (EPR) is defined by the Plastic Waste Management Rules of 2016 as a producer’s responsibility for the environmentally sound management of a product until the end of its life.

Applicability:

Every producer, brand owner, recycler, and manufacturer of plastic must register with the State Pollution Control Board or the Union Territory’s Pollution Control Committee.

Every waste generator, local body, Gram Panchayat, manufacturer, importer, and producer of plastic materials is subject to the Plastic Waste Management rules.

Battery Waste Authorization

The Battery Management and Handling Regulations were implemented in 2001 with the primary aim of ensuring that discarded lead-acid batteries were handled safely by all stakeholder groups. To protect the environment, regulations are being established to monitor and record the sale or importation of lead-acid batteries, as well as the recall of used batteries by licensed recyclers for recycling. Improper lead production and disposal can cause occupational health hazards as well as environmental effects in the surrounding area. As a result, it is important to ensure that secondary lead production is carried out in environmentally friendly facilities approved by the Central or State Pollution Control Boards.

Who needs Authorization;

Every importer

Means a person who imports new lead-acid batteries or components containing lead thereof for the purpose of sale

Assembler

Means a person who manufactures lead-acid batteries by assembling various components

Re-conditioner

Means a person involved in repairing of lead-acid batteries for selling the same in the market
